Furthermore, you affirm your consent to abide by them. If you do not agree to these Terms, you shall be barred from accessing or utilizing the Luxurious pass Service.
1.3. The subsequent definitions shall be employed in these Terms:
- You / user(s) – the individual or individuals, making reservations for the Airport Services through the Luxurious pass Service
- Luxurious pass Service is an online platform (www.luxuriouspass.com website, websites, applications, tools, platforms and / or other devices), which allows users to make reservations for Airport Services
- Airport Services refer to a variety of services offered at airports (such as VIP lounge, VIP terminal, business lounge, Fast-track and similar services) or any other services provided by Service Providers, which can be booked using the Luxurious pass Service
- Service Provider(s) – a provider of Airport Services
- Information about Airport Services – the terms and conditions set by Service Providers regarding the reservation, provision, or cancellation of the booked Airport Service, instances where Service Providers refuse to provide the booked Airport Service to the user or the user declines to receive the booked Airport Service, refund procedures, and any other requirements that users must review and adhere to
- Luxurious Pass .Co is a company registered under the laws of kuwait with registration number 1474 ,kuwait (hereinafter referred to as – «Luxurious PASS»), which manages the Luxurious pass Service
- Booking ID is a unique reference code (bar code / alphanumeric / QR code) that confirms the user's reservation of Airport Services through the Luxurious pass Service, and grants the user the right to receive the Airport Services according to the terms and conditions of the reservation
- Payment operator is a payment service offered by banks and / or financial institutions, designed to facilitate transactions between individuals, legal entities, and / or individual entrepreneurs on the Internet, using personal computers and / or other mobile devices, through which users can make payments for Airport Services
1.4. These Terms are applicable solely to the reservation of Airport Services provided by Service Providers .
1.5. The Luxurious pass Service is exclusively available for personal and non-commercial use, and is intended for individuals who are at least 18 years old. By using the Luxurious pass Service, you acknowledge and confirm that you are using it for personal and non-commercial purposes, and that you are at least 18 years old.
2) Booking Airport Services
2.1. Airport Facilities can only be booked by individuals who are registered with the Exclusive Membership Service. To register, users must provide accurate personal details, including their complete name, phone number, and email address. Every user, upon registering with the Exclusive Membership Service, creates a unique personal account.
2.2. You recognize and agree that any person to whom you grant permission to access your personal account or share personal information within your account on the Exclusive Membership Service (such as login credentials) has the authority to use and access the Exclusive Membership Service on your behalf. You are solely responsible for the actions performed by such individuals, including booking Airport Facilities and making payments.
2.3. When you reserve Airport Facilities through the Exclusive Membership Service, you establish a direct and legally binding agreement with the Service Provider whose services you have reserved. Exclusive Membership acts solely as an intermediary between the user and the Service Provider. Exclusive Membership conveys the user's booking terms to the relevant Service Provider, issues the booking confirmation (Booking ID) to the user on behalf of the Service Provider, and facilitates payment acceptance (through the Payment Operator) for the Airport Facilities. You understand and accept that in all circumstances, Exclusive Membership is not a party to any agreement for the provision of Airport Facilities between you and the Service Provider.
2.4. The processes and instructions for reserving and providing services at the airport are laid out in the Details on Airport Services, which can be found on the Luxurious Pass Service. If you are in disagreement with these processes and instructions for booking Airport Services, you are not eligible to make reservations for such services.
2.5. All relevant information regarding Airport Services available on the Luxurious Pass Service is provided or published by the respective Service Provider. The Service Provider assumes complete and sole responsibility for the accuracy and up-to-dateness of the Details on Airport Services, including but not limited to: updates on pricing, availability of Airport Services, terms for cancellation of bookings, circumstances under which the Provider may refuse to offer services, user rejection of services, refund policies, and other particulars concerning Airport Services that can be reserved through the Luxurious Pass Service. Luxurious Pass cannot guarantee, endorse, or vouch for the accuracy, comprehensiveness, or validity of the Details on Services published by Service Providers on the Luxurious Pass Service. Luxurious Pass shall not be held responsible for verifying the Details on Services presented by Service Providers on the Luxurious Pass Service website.
2.6. All details presented on the Luxurious Pass Service must not be understood as a validation or suggestion by Luxurious pass (as the overseer of the Luxurious pass Service) of any Supplier or Airport Service Provider.
2.7. In order to finalize a reservation, it is mandatory to submit complete payment for the Airport Services.
2.8. By completing a reservation, you confirm that you have perused and unconditionally agreed to the procedures and guidelines for reserving and providing airport Services, the cancellation and refusal terms, and the refund procedure of your Service Provider.
2.9. By completing a reservation, you also give consent to receive supplementary information about the booked Airport Services, in addition to updates on our exclusive deals and promotional emails (in accordance with our privacy policy).
3) Clause: Source of Funds and Limitation of Liability
3.1 Representation and Warranty on Lawful Funds The Client hereby represents, warrants, and undertakes that all payments made to [Luxurious Pass Co.], whether in fiat currency, cryptocurrency, bank transfer, credit card, or any other form of consideration, are derived from lawful sources and are not, whether directly or indirectly, the proceeds of any criminal, fraudulent, or otherwise unlawful activity. The Client further affirms that such payments comply in all respects with applicable laws and regulations, including but not limited to anti-money laundering (AML), counter-terrorism financing (CTF), financial sanctions, and related compliance obligations under the laws of the State of Kuwait.
3.2 Client’s Sole Responsibility The Client acknowledges and agrees that they shall bear sole and exclusive responsibility for the legitimacy, lawful origin, and authorization of all funds, digital assets, or payment instruments used for any booking, deposit, or payment made to [Luxurious Pass Co.] or any of its designated partners, suppliers, or affiliates. In the event that any payment is subsequently determined, alleged, or suspected to have originated from unlawful, unauthorized, or otherwise improper sources, the Client shall fully and effectively indemnify, defend, and hold harmless [Luxurious Pass Co.], its directors, officers, employees, affiliates, agents, and representatives from and against any and all losses, claims, damages, liabilities, penalties, investigations, or expenses (including reasonable legal and professional fees) arising directly or indirectly therefrom.
3.2 Disclaimer of Liability [Luxurious Pass Co.] shall not, under any circumstances, be held responsible, liable, or obligated—whether in contract, tort, equity, or otherwise—for any transaction, payment, or booking that is, or is later discovered to be, associated with stolen, illicit, or unlawfully obtained funds or digital assets. [Luxurious Pass Co.] shall have no obligation to refund, reimburse, replace, or compensate the Client or any third party in connection with such transactions, nor shall it bear any responsibility for any resulting cancellations, forfeitures, or terminations of travel, accommodation, or related services.
3.3 Right to Refuse, Suspend, or Cancel Transactions [Luxurious Pass Co.] reserves the absolute right, at its sole discretion and without prior notice, to refuse, suspend, or cancel any booking, transaction, or payment where it has reasonable grounds to believe that such payment involves, or may involve, illegal, suspicious, or non-compliant funds. Such action may be taken at any time, including after the payment has been received, without any liability to the Client or any other party.
3.4 Cooperation with Authorities [Luxurious Pass Co.] reserves the right to fully cooperate with any law enforcement agencies, financial regulators, or other competent authorities in the State of Kuwait, or any other jurisdiction, in the investigation of suspected illegal or suspicious financial activity. Such cooperation may include, without limitation, the disclosure of transaction records, booking details, or Client information as required by applicable law or regulation. Any such cooperation shall not constitute a breach of confidentiality, data protection, or contractual duty, and shall not give rise to any claim, right, or remedy against [Luxurious Pass Co.].
3.5 Survival of Obligations The Client’s representations, warranties, indemnities, and obligations under this clause shall survive the completion, cancellation, or termination of any booking, contract, or service arrangement with [Luxurious Pass Co.]. Clause: Governing Law and Jurisdiction This Agreement and all disputes, claims, or proceedings arising out of or in connection with it shall be governed by and construed in accordance with the laws of the State of Kuwait and the , as applicable to the location of the relevant transaction or service rendered. The Parties agree that any dispute shall be subject to the exclusive jurisdiction of the competent courts of State of Kuwait, as determined by [Luxurious Pass Co.] in its sole discretion.
4) Cost of the Airport Services and the terms of payment
4.1. Unless explicitly stated otherwise, all prices for Airport Services displayed on the Luxurious Service include VAT and all other applicable taxes.
4.2. The automatic currency converter accessible on the Luxurious Pass Service is provided for informational purposes only, and the actual exchange rate may fluctuate. You acknowledge and consent that Service Providers and/or Luxurious Pass may, at their discretion, round the price paid to Service Providers to the nearest whole number in the currency in which the price is expressed.
4.3. Users are not required to make any additional fees or payments to Service Providers or Luxurious Pass, apart from the cost of the booked Airport Services.
4.4. The Airport Services you book must be fully prepaid during the booking process. The booking of Airport Services cannot be finalized until complete payment is made for these services.
4.5. Luxurious Pass, acting on behalf of and at the expense of the Providers, offers users the option to make payments for the Airport Services they have reserved through the Luxurious Pass Service using the Payment Operator, engaged by Luxurious Pass.
4.6. Users can make payments for the reserved Airport Services using a bank cards or any accepted payment methods. During the booking process, each user must provide accurate and valid payment details of a bank card or any accepted payment methods to the Payment Operator for processing payments related to the reserved Airport Services. You understand that Luxurious neither collects nor retains payment information, including bank card data or any other accepted payment methods, and that the general terms and conditions of the Payment Operator, along with its Privacy Policy, are applicable in this regard. Financial data will be exclusively used for settling payments related to the booked Airport Services. You confirm and guarantee that you will furnish the Payment Operator with precise personal information and payment details. Additionally, you acknowledge and agree that, in addition to these Terms, any payments made for the reserved Airport Services may be subject to supplementary terms (including a privacy policy) established by the Payment Operator.
5.A) Booking Confirmation
5.1. Following the completion of your booking through the Luxurious pass Service, you will receive a notification via email within 24 hours confirming whether your booking has been accepted by the Service Provider. In the event of confirmation, you will receive a distinctive Booking ID.
6).B INTELLECTUAL PROPERTY RIGHTS
Everything on our website, including the text, images, and videos, is protected by copyright law. We own or have permission to use all of this content.
You can print or download one copy of any page on our website for your personal use. You can also share the website with others in your organization.
You must not modify any of the content that you print or download. You also must not use any of the images, photographs, videos, audio sequences, or graphics separately from the text that goes with them.

This is referred to as "Cancellations and Denials."
6.2. Additionally, you possess the right to cancel your Service booking or decline to avail yourself of it.
6.3. Each Airport Service Provider independently establishes rules governing Cancellations and Denials, which encompass:
- Conditions for cancellations initiated by the Service Provider
- Conditions for cancellations initiated by the User
- Conditions under which the Provider may decline to offer the Airport Services
- Conditions for the User's refusal to receive the Airport Services
- Policies regarding chargebacks in the event of Cancellations and Denials
The aforementioned terms for Cancellations and Denials, along with the chargeback policy, are detailed in the Information about the Airport Services provided by the Providers.
6.4. In the event of a Cancellation of the reserved Airport Services initiated by the Supplier, you will promptly receive notification at the email address you provided during the booking process.
6.5. You are subject to the terms and conditions governing Cancellations and Denials, as well as the prevailing chargeback policy at the time of your Airport Service booking.
6.6. Requests to cancel a booking, if initiated by the User, must be submitted through the user's personal account.
7.B) MATERIAL PROVIDED BY YOU
You must not send or upload anything to our website that is illegal, indecent, or untrue. You must also not infringe our intellectual property rights or the rights of anyone else. Your content must not be defamatory, unreliable, or misleading. It must also be free of bugs, worms, or viruses.
You are solely responsible for the content that you send or upload to our website. 7.B) RELIANCE ON INFORMATION POSTED
The contents posted on our website, including commentary and other materials, are not intended to serve as advice upon which you should rely. Consequently, we absolve ourselves of any liability and responsibility that may arise from any reliance placed on such materials by any visitor to our site or by anyone who becomes aware of any of its contents.
8) Disclaimer
7.1. LUXURIOUS PASS SHALL NOT BE LIABLE TO USERS OR THIRD PARTIES FOR THE PROVISION OF THE AIRPORT SERVICES (INCLUDING, BUT NOT LIMITED TO, THEIR QUALITY, COMPLIANCE WITH THE DESCRIPTION, OR ANY CANCELLATIONS OR DENIALS). FULFILLING OBLIGATIONS RELATED TO THE AIRPORT SERVICES IS THE SOLE RESPONSIBILITY OF SERVICE PROVIDERS. ANY CLAIMS OR COMPLAINTS REGARDING THE AIRPORT SERVICES MAY ONLY BE FILED TO SERVICE PROVIDERS.
8.2. In accordance with the restrictions set forth in these Terms, in the cases established by law, Luxurious Pass shall be liable only for direct damages done to, paid for or suffered by users due to the unfair fulfillment of our obligations set forth in these Terms. In any case, our liability (for a single event or a series of related events) is limited to the cumulative sum of the total cost of your booking specified in the email confirmation received by the user in accordance with clause 4.1. of these Terms.
8.3. Luxurious Pass shall not be liable for any damages (direct losses, lost profits), payment of any penalties (fines and other sanctions), any other losses or expenses made, incurred or paid by you, arising from or in connection with the use, inability to use or delay in the operation of the Luxurious Pass Service. Luxurious Pass also disclaims any liability for (i) any inaccuracies related to the Information about the Airport Services provided by Service Providers on the Luxurious Pass Service and (ii) the rendering of such Services by the Providers. Luxurious Pass shall not be liable for any interruptions in the Luxurious Pass Service (for example, due to technical breakdown, repair, upgrading or maintenance of the Luxurious Pass Service or for any other reason).
8.4. Luxurious Pass also shall not be liable for errors (including obvious and typographical errors), as well as any inaccurate, misleading or incorrect information (incompleteness or non-provision of such information). Each Service Provider shall be liable at all times for the accuracy, completeness and correctness of the Information about the Airport Services (including information on pricing and availability of certain Airport Services) published on the Luxurious Pass Service, as well as any other information published or provided for publication on the Luxurious Pass Service. Obvious errors contained in the Luxurious Pass Service do not entail legal obligations.
8.5. Any claims or complaints regarding the Luxurious Pass Service or any Airport Service, action or event for which Luxurious Pass may be liable must be submitted in a timely manner, but no later than 1 (one) week after the date of the event or action, which is the basis for such a claim or complaint. Any claim or complaint filed after the expiration of 1 (one) week may be rejected, and its bearer will lose the right to any compensation or refund. Luxurious Pass is not obliged to provide its services in case of failures in its technical infrastructure, software, servers or failures in technical infrastructure, software or network resources of other entities on which Luxurious Pass Service depends, or in case of errors or failures in its own servers.
